This Privacy Policy describes how TEN EIGHT STUDIO LLC ("we", "us", "our") collects, uses, and protects your personal information when you use Scrubjay (the "Application"). This policy applies to users worldwide.

By installing or using the Application, you agree to the practices described in this policy.

Your files stay on your computer

We do not upload, access, or store any video files you add to the Application. All processing happens locally on your device — your files never leave your computer.

Limited personal data

The only personal information we store is your display name and email address.

We do not store your password

Account creation is done through a social provider (Google or Discord). We never see or store your password — that stays with your OAuth provider.

We do not sell your data

No data or personal information will be sold, rented, or shared with advertisers or data brokers. Ever.

You are in control

You can request access to, correction of, or deletion of your personal data at any time by contacting us or deleting your account inside the Application.

Account Information

We do not offer a traditional username/password sign-up. Instead, you create an account using a third-party OAuth provider such as Google or Discord. When authenticating, we receive and store the information above.

We do not receive or store your password. All authentication is handled by the OAuth providers. Please refer to their privacy policies for more information:

Device Information

We collect a unique device identifier from the device on which you install the Application. This identifier is used solely to enforce free trial limits and prevent abuse (e.g. creating multiple free trial accounts). It is not used for advertising or tracking purposes. The identifier is an anonymous value that cannot be used to identify a user on its own.

Subscription Status

Upon creating an account you will receive a 3-day free trial. After that, a subscription is necessary to continue using the Application. We receive a subscription status from Polar.sh, our Merchant of Record (MoR), which is persisted for use within the Application. We do not save payment information — see the "Payment Information" section below for more details.

Information We Do NOT Collect

Video & Audio Data

All video files added to the Application are processed locally on your device. We do not upload, transmit, access, or store any video content, audio, or file metadata. The file never leaves your computer.

Payment Information (Handled by Polar)

Payments are processed through Polar, who acts as the Merchant of Record for all transactions. When subscribing, Polar's checkout page opens in your browser. All payment data is entered directly into Polar's website and governed by their own Privacy Policy and Terms of Service.

We do not receive or store any payment information from Polar. Upon subscribing we receive and store only a subscription status to enable features within the Application.

How We Use Your Information & Why It's Needed

If you are located in the European Economic Area (EEA) or the United Kingdom, data protection law requires us to have a specific legal justification for each type of data we process.

  • Your name and email address are processed on the basis of contract performance — they are necessary to create your account and deliver the service.
  • Your device identifier is processed on the basis of legitimate interests: preventing trial abuse is a reasonable business need, and the identifier is anonymous, used for no other purpose, and not shared with third parties.
  • Any data we are required to retain for tax or regulatory compliance is processed on the basis of legal obligation.

Your Rights as a User

Regardless of where you live, you have the right to access the personal data we hold about you, request correction of anything inaccurate, and ask us to delete your data, subject to any legal retention requirements.

EEA & United Kingdom (GDPR / UK GDPR)

You have the right to receive your data in a portable, machine-readable format, to request that we restrict how we process your data, and to object to processing based on our legitimate interests. You also have the right to lodge a complaint with your local data protection authority — for example, the ICO in the UK or your national supervisory authority within the EU.

California Residents (CCPA / CPRA)

You have the right to know what personal information we have collected about you, to request its deletion or correction, and to opt out of any sale of your data. We do not sell personal information. You also have the right not to be discriminated against for exercising any of these rights.

Brazil (LGPD)

You have rights of access, correction, anonymization, portability, and deletion, as well as the right to information about how your data is shared.

International Data Transfers

Our servers are located in the United States. If you are accessing the Application from outside the US — including from the EEA, the United Kingdom, or any other country — your personal data will be transmitted to and stored on servers in the United States. US data protection laws may differ from those in your country of residence.

For users in the EEA and United Kingdom, we rely on Standard Contractual Clauses (SCCs) approved by the European Commission as the legal mechanism for this transfer, which obligates us to protect your data to a standard equivalent to that required within the EEA.

For users in other regions, by installing and using the Application you acknowledge that your data will be processed in the United States. We handle all data in accordance with this Privacy Policy regardless of where you are located.

Children's Privacy

The Application is not intended or directed for children under the age of 16. We do not knowingly collect information from children. If we learn that any data from a child under 16 has been collected we will promptly delete it. As mentioned in the sections above, the Application interacts with a handful of third-party services. Please refer to their privacy policies for details on how they handle your data. We are not responsible for the privacy practices of these services.

Changes to This Policy & Contacting Us

This policy will be updated alongside changes to the Application. We may email you about significant changes. Our values around data security and protecting your information will not change.
